Comment withdrawn. Not worth the effort.

Re: Potential Lawsuit of all Photographers who post to

The second work of the Patent is process. This patent seems very vague of details and appears to apply to any photos sold online. I know he has his own propietary software that he tried to sell but this does not seem to define that. I have never seen the software ony the Photo Crazy website.

We all download our pictures to a computer. A network is 2 or more computers and could be just your personal computer and the shared web server of your host that you upload to.

If you want to sell your photos online they must be searchable and that could amount to as little as selecting one out of ten pictures. The date and time is in your picture's EXIF data. We also sort by competitor's number. You will also need some method (undefined) for the customer to order the pictures from your website.

Apparently this will also third party websites that do the selling for you. I have tried to contact several to alert them but most do not have email. If you use one please contact them as most have patent lawyers.

The one I contact by phone said this patent will never stand up in court.

When I contact the Patent office by phone, they said this patent could be rescinded if there were others doing the same thing prior to the filing in 2000.

Am I in violation of his patent if I don't use tethered cameras to capture images or use bib numbers (and is there a difference between a bib number and a car number?) or keep track of the images by when they were taken, but I do offer them for sale on the web and my customer can search for their event based upon the date of the event and find my photos some other way?

Hi Norm,

It looks like the important part of this patent is that it covers searching for a photo which is stored on a website using a number or a time (11:30 PM).

Brightroom.com allows searching by a race number, as does Marathon-photos.com

Re: Potential Lawsuit of all Photographers who pos

I actually file my images by participant number into sub galleries or sections..

The online store allows for a search by gallery name which is that number.

I use a CSI script that when a participant enters their participant number on my home page the script uses a table with hyperlinks of each participant gallery to direct them to their store.

We log during the event each of the partipants as they pass... create a data file and have software that moves photos into subfolders by participant # each day more images are added to these folders/galleries. We review all the images against our datafile befor the images are movd to these folders and in in each folder for validity at the end of the event.

Unreadable numbers are put in galleries by time range by day and or by letter designation as the participants passed. Images are renamed to the time taken for lookup as well.

Yeah this has my attention as I have been doing this since the summer of 2003...

I use Printroom.com PSM because it creates galleries for the 17,000 images and 1600+ gallleries in a few hrs.

I dont see why I would owe this guy anything as I have done this all on my own yet if a lawyer on his side with this document wanted to take me to court it would cost me money I wouldnt have.

What kind of insurance would cover me for this garbage?

Re: Potential Lawsuit of all Photographers who post to

All of us that may be effected should write the Patent Office with our complaints.

The users/designers of similar software/sork process prior to 2000 should also write and explain that to the Patent Office.

They told me that this can be rescinded. But it will stand if no one complains.
