i'm asking just that.... in regards to fair use of an image, does it matter if i charge for a class that i run from my studio/home vs. a "normal" education facility, ie school/college?

I am guessing here Michael, but I think the distinction is not whether it is a normal educational facility versus your studio or home but whether it is a commercial enterprise versus non-profit.

A third case to be noted is American Geophysical Union v. Texaco,(17) which dealt with photocopying by a for-profit corporation for research purposes (the copies were made by a scientist in the research lab). The court held that the for-profit corporation was not entitled to the right of fair use, but said "our opinion does not decide the case that would arise if Chickering [the copier] were a professor or an independent scientist engaged in copying and creating files for independent research."(18)

My guess is that if your profiting from someone else's copyrighted work, then they deserve their fair share of the pie.

Again, I am merely guessing with one citation. Perhaps someone else will chime in.

yeah to put it another way.... i always thought of fair use for education being for highschools, colleges etc..... but a local target shooting facility does classes on shooting, safety etc... i was curious to know if thats the same for fair use of images...

they are not/i havent done work for them, just an example.
