i noticed on several occassions when online and using this site or that or downloading this software, i commonly come across some thing like 'by using this xxxx you agree to the terms of conditions below'.

i would like to know what law supports this...

is this just a good as a signed contract?

They are called "click-wrap" agreements and there is court precedent that supports them in the United States so I have been told by several different attorneys. I use one at the entrance to the photo gallery on my website.

There is a difference between the "click-wrap" agreements and the disclaimer on your website.

The click-wrap agreement gives the user limited rights to use the product.

Your disclaimer is a statement of facts about copyright infringement which may scare away some potential infringers, but is not legally binding.
