Whatever course of action you take, I recommend you document it exhaustively. In the end, these things often come down to whoever has the most complete, unimpeachable story to tell.

It sounds as though you may have resolved this, but in general, make sure you register all your work with the US Copyright office. I have links on my site to a variety of things, incl. their site & basic regulations, at Everyday Journey / FTA Photos. The jist is that electronic theft of copyrighted material is a HUGE statuatory financial hit on the other party, and if your stuff is registered, you can collect statuatory penalties near-automatically, without incurring lawyer fees nor doing it alone (plus you can confiscate their photo, their profits, have them shut down, etc.) ISP providers know they can be hit up for this, too, hence they co-operate at taking things down rather than be in the middle of a suit. But the first step always is to have your stuff registered PRIOR to your publishing it anywhere, web included. 'Good luck with everything,

They were apologetic. I offered to sell them the rights to use the image, but they chose instead to alter their banner image with another moon shot from somewhere else.
